Class action suit brought against Hamilton County Coal and Alliance Resources over layoff notices

A class action lawsuit has been filed against Alliance Resource Partners and Hamilton County Coal by a miner affected by the lasted round of layoffs.

KFVS-12 News is reporting that Franklin County miner Carl Leeper filed the suit on behalf of the 200 miners and their families after he says the company did not provide 60 day advanced Worker Adjustment and Retraining or WARN Act notice that layoffs were coming.  According to the report, Leeper said through his attorney that workers were given less than 24 hours notice of the layoffs.

In the suit, Leeper is asking for back pay, restoration of benefits, and to recoup attorney’s fees, all of which are part of the WARN Act.
